Important Regulations to Know

Overview

Below are some of the important rules and regulations you need to know about. All wetlands, watercourses, and waterbodies are protected by the Inland Wetlands and Watercourses Commission. Local ordinances exist which regulate the use of public water bodies and the installation of docks, buoys, floats, etc; and those living near Highland Lake must adhere to the Highland Lake District Zoning Regulation.

Local Ordinances/Regulations

  • Town Ordinances:
  • Highland Lake District: Zoning rules govern development, coverage, and setbacks
  • IWWC: Oversees activities near all Winchester wetlands and watercourses 

  • Regulated Activities:
    Regulated Activities are those within wetlands, watercourses, and upland review areas which DO require a permit. This includes most activities which include removal or deposition of material, or disturbance of land.

    Definitions:
    REGULATED AREA -
    That area within 75 feet of any inland wetland or within 100 feet of any watercourse as defined in these regulations.

    DISTURBING THE NATURAL AND INDIGENOUS CHARACTER OF THE WETLAND OR WATERCOURSE - To alter the inland wetlands or watercourses by reason of removal or deposition of material, clearing the land, clear-cutting of trees, alteration or obstruction of water flow, or will result in the pollution of the wetland or watercourse.

    Permitted Activities:

    Permitted Activities are those things that are allowed within the Regulated Area without the need for permits, they include: 
    • Farming Activities
    • Routine Maintenance
    • Boat anchorage and mooring, not including dredging or dock construction

State & Federal Guidelines
Both the State of Connecticut and the Federal Environmental Protection Agency have enacted various rules and regulations in order to protect our water resources. Below are links to just a few of those.

    • Septic Systems - Often the cause of nutrient loading into lakes and ponds 
    • Fertilizers - Another source of nutrient loading into lakes and ponds 
    • Invasive Species - Species that are not native to our area and pose significant threats to our ecosystem 
    • Stormwater Management - Regulations pertaining to protecting the natural environment from the negative effects of site development
    • Pesticide Management - Certain pesticides can be harmful to aquatic life if not used appropriately
